CHERRY VALLEY, CALIFORNIA — A 49-year-old Idaho man driving a commercial vehicle on westbound Interstate 10 near Cherry Valley Boulevard was arrested for DUI last week after CHP San Gorgonio Pass officers stopped him for excessive speed, failing to maintain his lane, and being out of lane — and found his BAC was more than twice the legal limit for commercial drivers.
Officers observed signs of alcohol impairment during the stop. The driver’s BAC came back above 0.08 percent — more than double the 0.04 percent limit that applies to commercial vehicle operators.
CHP used the arrest to remind commercial drivers of the serious consequences that come with a DUI behind the wheel of a CMV. A first DUI conviction or a BAC of 0.04 percent or higher in a commercial vehicle results in at least a one-year CDL disqualification. A second qualifying conviction in a separate incident can result in a lifetime ban from operating a commercial motor vehicle. DUI convictions in a personal vehicle can also trigger CDL disqualification.
All defendants are presumed innocent until proven guilty in a court of law.
