LYNN, MASSACHUSETTS — A 42-year-old Lynn man is facing federal charges for arranging to use a Bluetooth earpiece to cheat on his Massachusetts Commercial Learner’s Permit exam, with a co-conspirator feeding him answers in real time — a scheme that was later exposed when he explained it in detail to an undercover federal agent wearing a recording device.
Rudy Nolasco was charged with fraudulently producing an identification document and made his initial appearance in federal court in Boston on October 13. He was released on conditions. If convicted, he faces up to 15 years in prison, three years of supervised release, and a fine of up to $250,000.
According to charging documents, Nolasco had previously taken the CLP exam and failed. In November 2021 he arranged to sneak a Bluetooth earpiece into the exam, allowing co-conspirator Frank Castro to feed him answers in real time.
The scheme unraveled when Nolasco met with an undercover agent wearing a recording device and explained the operation in detail — including how to pay Castro and how to use the Bluetooth device to pass the exam. The undercover agent paid Castro $3,000, went to the DMV in Danvers, and passed the CLP exam with Castro providing answers through the earpiece.
Castro was convicted following a jury trial in January 2026 and sentenced in May 2026 to time served — approximately 23 months in prison.
